Hepworth Blinds and Shutters Limited- terms and conditions
1. APPLICABILITY OF CONDITIONS
1.1 These terms are accepted when the buyer places an order, makes a minimum payment of 50% and the seller accepts thereof.
1.2 Payment can be made by cash, credit/ debit card, cheque, or bank transfer in person at the buyer’s address or one of our Hepworth Blinds showrooms.
1.3 When an order is placed over the phone by card or bank transfer, a receipt and order copy will be sent via post or email for confirmation.
2. SALES APPOINTMENTS, PRODUCT INFORMATION & IMAGE DOCUMENTATION/ DISPLAY
2.1 Sales Appointments and quotations within catchment areas are free of charge and non-obliging. However, appointments outside of a 10-mile distance from our showroom may be subject to a travel fee, depending on the distance. Should the buyer proceed with the order, the travel fee will be deducted from the order total.
2.2 Whilst the seller takes every precaution in the preparation of its website, social media, collection books, technical information, price lists and other selling aids, these documents are for the buyer’s general guidance only. The particulars contained therein shall not constitute representation by the seller and the seller shall not be bound thereby. The seller reserves the right to change specifications at any time.
2.3 Any colours and textures described verbally are general guides only to the likeness, and their particulars shall not constitute true representations by the seller and the seller shall not be bound thereby. Samples are available and recommended.
2.4 Images shown are guides only and preciseness of colour cannot be guaranteed.
2.5 Samples are supplied as a guide only, as the final batch used to make your order may be from a different batch to the sample.
2.6 Wood samples and stock timbers change from batch to batch. Wood blinds are a natural product and vary in its grain and colour.
This is not a fault but a characteristic and beauty of wood. Over time there may be slight warpage and twists therefore it is not recommended to use is high moisture areas.
2.7 Roller and roman blinds over a certain size may have a join. This will be specified on your order. Blinds supplied with joins are not faulty and are made to specification.
2.8 All sizes quoted are width x drop. This is industry standard, and we only accept orders in this form.
2.9 Although our salespeople are experienced, it is your responsibility to confirm the specifications of your order before signing the order acknowledgement.
3. PRICE PROMISE & PROMOTIONAL OFFERS
3.1 Our price promise guarantee and promotional offers are for new orders only and does not cover orders already placed.
3.2 The price promise does not cover competitors promotional offers or pricing errors.
3.3 We cannot match prices for items being sold below trade/ manufacturing prices.
3.4 The price promise will be honoured only once per supplier.
3.5 The order specification must be like for like including manufacturers hardware.
3.6 Competitors quotes must be supplied in writing. Verbal quotes will not be matched.
3.7 Multiple offers cannot be used in conjunction with each other.
3.8 Promotional offers are for limited times and cannot be redeemed once expired.
3.9 Hepworth Blinds and Shutters Limited reserve the right to withdraw any offer/ promotion at any time without notice or warning.
4. CANCELLATIONS OR AMENDMENTS OF ORDER BY THE BUYER
4.1 All lead times are approximate. No refunds or discounts will be given if there are delays.
4.2 You may only cancel your order and receive a refund if fabric/ components have not been ordered, or production has not started.
4.3 On cancelled orders, a charge of £20.00 will be applied to cover administration costs.
4.4 If an order has multiple blinds from different ranges/ suppliers, the total order cannot be refused, cancelled, or returned where only part of the order is incorrect, delayed, or unavailable.
2.5 On all orders that are unable to be cancelled as per the above points, the full outstanding balance will be pursued even if the buyer refuses to accept the goods.
5. CANCELLATION BY THE SELLER
We reserve the right to cancel your order if:
5.1 We have insufficient stock to deliver the goods you have ordered.
5.2 One or more of the goods ordered was listed at an incorrect price due to typographical error or an error in the pricing information provided.
5.3 Your blind exceeds to maximum or minimum width and drop combination.
5.4 The selected fabric/ slat is no longer an available option.
5.5 In the event the buyers order is cancelled, the seller will not be obliged to offer any compensation for disappointment suffered.
6. OUTSTANDING BALANCE
6.1 The seller will always take a minimum 50% deposit on the date of the order. The remaining balance must be paid before delivery/ collection, usually 2 working days before.
6.2 The seller will only accept payment by cash, debit/ credit card or bank transfer. Cheques can be made but must clear before scheduled delivery.
6.3 Failure to pay the full balance before this point will result in the blinds being supply only and the matter will be referred to debt collection and associated litigation proceedings.
6.4 Non-payment of the remaining balance will result in the seller applying interest to the outstanding balance and accrued costs (admin and associated litigation fees) from the arranged installation date, at a rate of 0.5% per day until the balance is paid in full or resolved through the debt collection process.
6.5 All products remain the property of Hepworth Blinds and Shutters Limited until all payments are complete.
7. DELIVERY/ FITTING
7.1 Fitting service is included with orders over £100. Orders below this amount are supply-only or will incur an additional fitting fee.
7.2 Appointments beyond a 10-mile distance from our showroom may be subject to a travel fee, depending on the distance.
7.3 All deliveries are fully insured, and a signature will be required on delivery.
7.4 Any dates, times, or periods for delivery of goods quoted are estimates only. The buyer will not be entitled to refuse acceptance of the goods or cancel the contract with the seller due to delay.
7.5 We will inform the buyer of any severe delays or, in the unlikely event, cancellations as soon as possible. The buyer will not be entitled to a refund or discount for cancelled or rescheduled appointments.
7.6 After 2 failed delivery attempts, a re-delivery charge of £45.00 may be applied before each additional dispatch.
7.7 As per point 3.4, should the blind not fit due to the sellers’ error, we will replace the blind free of charge within a reasonable time frame.
7.8 Hepworth Blinds and Shutters Limited does not take responsibility for any damages during fitting, especially when drilling tiles. Furthermore, it is not our responsibility to clear windowsills, work tops, or any areas where the blinds are being installed.
8. FITNESS FOR PURPOSE
8.1 While great care is taken in making your blinds to the size requested, all blinds are produced with a tolerance of +/- 5mm. This is industry standard.
8.2 If the buyer wishes to supply their own measurements, payment must be taken in full on the date of order.
8.3 In the event that the blinds are unfit for purpose through fault of the buyer, the buyer has no right to a refund and remakes and/or adjustments will be chargeable.
8.4 In the event that the blinds are unfit for purpose because of the seller, the buyer has no right to a refund as the seller reserves the right to apply the necessary solutions to correct the order within a reasonable time frame.
9. RETURNS OF GOODS
9.1 In general with common law, ‘bespoke’ goods cannot be returned. Every blind is custom made (made to measure) to your specific requirements; therefore, once made, is suitable only to you and cannot be resold.
9.2 The return of goods will not be accepted without prior approval by the seller. Upon return, the goods will be inspected to verify the return reason, and once confirmed, a replacement/ repair will be sent.
9.3 All damaged or incorrectly supplied goods must be returned to us (at our cost) for verification before we can action either a repair or replacement.
9.4 If any returned blinds are found not to be damaged or faulty and are as ordered, to specification, a re-delivery charge of £45.00 will be applied before the goods are returned.
9.5 Goods received damaged, incomplete, or incorrect must be reported to the seller within 2 days of receipt. This is industry standard and to prevent claims of accidental damage by the buyer. This does not affect your standard warranty which is valid for 12 months from date of installation/ receipt.
10. CLAIMS
10.1 The seller shall be under no liability whatsoever to the buyer for any indirect or consequential loss however so arising.
11. WARRANTY
11.1 A 12-month warranty is offered with all our products. After the warranty expires, you will be charged for costs of repair plus £45.00 for a call out fee where necessary.
12. COMPLAINTS
12.1 All goods and installation work should be checked on completion with a staff member present.
12.2 If you believe there is a problem, you should contact us via email at contact@hepworthblinds.co.uk or in writing at the address overleaf to inform us of any issues. We will respond to your contact as soon as possible.
12.3 In the event that we are unable to resolve the matter to your satisfaction, you may refer the complaint to the British Blind and Shutter Association’s Mediation Service if you are seeking rectification only, or through Small Claims Court.
13. PRIVACY POLICY
13.1 We may collect, store, and use information about individuals who contact us via telephone, internet, or face to face.
13.2 You may supply us with information about you by request for home visits, placing orders in store, or filling in contact forms on our website. The information you provide us may include your full name, address, phone number and email address.
13.3 We will use this this information to provide you with information and/ or services that you request from us. We may also use this information as part of our customer care follow up where we may hold this information for up to 3 months.
13.4 Any information provided to us will either be emailed directly to us if using our website or may be stored on a secure server.
13.5 We do not rent, sell, or share personal information about you with other people or non-affiliated companies. We will use all reasonable efforts to ensure that your personal data is not disclosed to regional/ national institutions and authorities, unless required by law or other regulations. Should you choose not to use our services, your personal details are destroyed immediately.
13.6 You have the right to ensure your personal data is being processed lawfully (“Subject Access Right”). Your subject access right can be exercised in accordance with data protection laws and regulations. We will provide your personal data to you within the statutory time periods. To enable us to trace any of your personal data that we may be holding, we may need to request further information from you. If you have a complaint about how we have used your information, you have the right to complain to the Information Commissioner’s Office (ICO).
Our T’s&C’s are available on request and by agreeing to an order, you agree and accept our T’s&C’s and understand that you are entering into a contract with Hepworth Blinds and Shutters Limited.
